This document is an official public offer. By using the moscowskiy.com website and submitting a booking request, you accept the terms set out below in full. Please read them carefully.
This English text is provided for convenience. The relationship between the parties is governed by the law of the Russian Federation; in the event of any discrepancy, the Russian-language version of the offer prevails.
1. General provisions
1.1. This public offer (hereinafter — the "Offer") is an official proposal of OOO "Eskort Servis" (TIN 7705603716, KPP 772401001, OGRN 1047796438799) (hereinafter — the "Operator") to conclude an agreement for the provision of information and intermediary services on the terms set out below.
1.2. In accordance with clause 2 of Article 437 of the Civil Code of the Russian Federation, the Offer is public and addressed to an indefinite range of legally capable individuals who have reached the age of 18.
1.3. The performance by the User of the actions specified in Section 4 is deemed acceptance — full and unconditional acceptance of the terms of the Offer. From the moment of acceptance, the agreement between the Operator and the User is considered concluded.
1.4. The Operator has the right to amend the terms of the Offer unilaterally. The current version is always available on the Website at moscowskiy.com/oferta.
2. Terms and definitions
- Website — the internet resource moscowskiy.com, including all its pages and subdomains.
- Operator — the person specified in Section 12, who owns the Website and provides information and intermediary services.
- User (Client) — a legally capable individual who has reached the age of 18 and uses the Website.
- Companion — an individual whose profile is published in the Catalogue and who provides social and business companionship services.
- Companionship services — services of social, business and society companionship of a non-sexual nature: presence at business and social events, keeping a conversation going, companionship on trips and tours, and the like.
- Catalogue — the section of the Website containing the profiles of Companions.
- Request — an enquiry for the booking of Companionship services submitted by the User through the Website.
- Booking — an arrangement, confirmed by the Operator and the Companion, regarding the date, time and conditions of the Companionship services.
3. Subject of the Offer
3.1. The Operator provides the User with access to the Catalogue and supplies information and intermediary services: selection of a Companion at the User's request, receipt and processing of Requests, and organisation of interaction between the User and the Companion for the purposes of a Booking.
3.2. Companionship services are provided directly by the Companion. The Operator is not the provider of Companionship services; its role is limited to an information and intermediary function, unless the Parties expressly agree otherwise.
3.3. The Operator carries out a preliminary check of Companions' profiles before publication; however, it does not guarantee the outcome of the Companionship services and is not liable for the actions of Companions beyond the limits established by Section 10.
4. Acceptance of the Offer
4.1. Acceptance is deemed to be any of the following actions of the User: submitting a Request through the form on the Website; contacting the Operator via the contacts stated on the Website for the purpose of a Booking; any other use of the Website expressing an intention to use the Services.
4.2. By submitting a Request, the User confirms that they have reached the age of 18, possess full legal capacity, and have read this Offer and the Personal Data Processing Policy.
5. Procedure for placing and confirming a Request
5.1. The User selects a Companion in the Catalogue and submits a Request, stating the date, time, duration, format of the event and contact details.
5.2. The Operator coordinates the Request with the Companion and sends the User a confirmation with the final terms. During working hours (daily 10:00–23:00 Moscow time), processing a Request takes, on average, up to 30 minutes.
5.3. A Booking is deemed to have taken place from the moment the User receives the confirmation.
5.4. The Operator and the Companion have the right to decline a Request, including where there is doubt as to its compliance with the nature of the Services (Section 6).
6. Nature of the Services
6.1. Companionship services are exclusively of a non-sexual, social, business and society nature.
6.2. The Website and the Operator do not provide, offer or advertise services of an intimate nature. A Booking does not include and does not imply intimate, sexual or any other services beyond the scope of society companionship.
6.3. Requests containing a demand for services of an intimate nature, as well as proposals of an unlawful nature, are declined. The Operator has the right to deny such a User access to the Website.
7. Cost of the Services and settlement procedure
7.1. The cost of the Companionship services is stated in each Companion's profile and fixed in the Booking confirmation.
7.2. Settlement is made by the User in cash or by transfer upon completion of the Services, unless otherwise provided by clause 7.3.
7.3. For Bookings involving trips to other cities and for multi-day Bookings, a prepayment may be provided for. The cost of travel, accommodation and meals for the Companion on trips is borne by the User and agreed before the trip begins.
7.4. There are no hidden payments: the final cost is communicated to the User in the Booking confirmation.
8. Rights and obligations of the Parties
8.1. The User undertakes to provide accurate data, to comply with the legislation of the Russian Federation and the terms of the Offer, to treat the Companion with respect and to make settlement in good time.
8.2. The User has the right to receive accurate information about the Services, and also to cancel and reschedule a Booking in accordance with Section 9.
8.3. The Operator undertakes to ensure the operation of the Website, to process Requests and to process personal data in accordance with the Policy.
8.4. The Operator has the right to amend the Catalogue and the roster of Companions, to decline Requests, and to restrict access to the Website in the event of a breach of the Offer.
9. Cancellation, rescheduling and amendment of a Booking
9.1. The User has the right to cancel or reschedule a Booking, notifying the Operator as soon as possible.
9.2. The conditions for cancellation and rescheduling, as well as the procedure and time frame for the return of any prepayment made, are determined in the Booking confirmation and are governed by the legislation of the Russian Federation, including the Law of the Russian Federation of 7 February 1992 No. 2300-I "On the Protection of Consumer Rights".
9.3. Where the Services cannot be provided due to circumstances beyond the Parties' control, the Operator notifies the User and offers an alternative Companion or another date.
10. Liability of the Parties
10.1. For non-performance or improper performance of obligations, the Parties bear liability in accordance with the legislation of the Russian Federation and this Offer.
10.2. The Operator is not liable for the actions of Companions and Users beyond its information and intermediary function, nor for circumstances of force majeure.
10.3. The Website and its content are provided on an "as is" basis; the Operator does not guarantee its uninterrupted operation.
10.4. The aggregate liability of the Operator is limited to the cost of the relevant Booking.
11. Dispute resolution
11.1. Disputes are resolved through negotiations. A pre-action claim procedure is mandatory; the time frame for responding to a claim is 30 (thirty) calendar days.
11.2. If agreement is not reached, the dispute is referred to a court in accordance with the legislation of the Russian Federation.
12. Final provisions
12.1. The Offer takes effect from the date of its publication on the Website and is valid indefinitely until it is withdrawn or replaced.
12.2. The legislation of the Russian Federation applies to the relations between the Parties.
